BAXTER OF CALIFORNIA BEST SELLERS GIVEAWAY OFFICIAL RULES

GIVEAWAY DESCRIPTION:

The Best Sellers Giveaway (“Giveaway”) will begin on Wednesday, October 16, 2024 at 12PM PT and ends on Wednesday, October 23, 2024 at 12PM PT (“Giveaway period”).  This Giveaway will be conducted exclusively through social media via TikTok (@baxterofca). Three (3) winners from Baxter of California’s TikTok will awarded one (1):

  • Clay Pomade
  • Deodorant
  • Exfoliating Body Bar

Entries must be made by following, liking, and tagging a friend on Baxter of California’s Best Sellers Giveaway post via TikTok. Winners must respond within (48) hours to claim their prize.

HOW TO ENTER / EXECUTION:

Followers of Baxter of California, who are legal residents of the United States (other than residents of the States of Florida, New York and Rhode Island) 18 years of age and older will be able to take part in this Giveaway.  To participate in the Giveaway, consumers must do the following:

  1. To participate in this Giveaway, participants must have their own TikTok account and follow Baxter of California on TikTok (@baxterofca), all participants must like the Best Seller Giveaway post, and tag a friend in the comments.
  2. All entries must be received by 12pm Pacific Standard Time on Wednesday October 23, 2024 or they will be void.
  3. All audiences must meet the below-listed Entry Requirements.
  4. Winners will be selected on Thursday, October 24, 2024 by 12PM PT by random drawing done by Baxter of California from among all eligible entries received online/social media.  Winners will receive a DM on behalf of Baxter of California announcing that they have (48) hours to respond via DM to claim their prize. If they do not respond within the allotted time, Baxter of California reserves the right to move on to another Giveaway Participant.
  5. Winners will be asked to provide their Full Name, Phone Number, Email Address, and Mailing Address, City/State to claim the Prize.
  6. Any registration information and/or submissions provided by participants for purposes of this Giveaway will be disclosed to Baxter of California (“Brand”) only.
  7. All decisions made by Baxter of California management regarding any aspect of this Giveaway is final.

ENTRY REQUIREMENTS:

  • Participants must follow Baxter of California on TikTok (@baxterofca)
  • Like and tag a friend on Best Sellers Giveaway post to enter
  • Submissions must not infringe upon any rights of any third party including without limitation, copyright, trademark and right of publicity or privacy

ELIGIBILITY RESTRICTIONS:

  1. The Giveaway is open to all eligible participants who are 18 years of age and older and legal residents in the United States and the District of Columbia, except residents in Florida, New York and Rhode Island are not eligible.
  2. Employees of Baxter of California, its subsidiaries, affiliates, general sponsors, advertisers, competitors, promotional partners, and members of the immediate families or those living in the same households (whether related or not) of any of the above are NOT eligible to participate or win in this Giveaway.  For purposes of this Giveaway, immediate family members mean spouses, parents, grandparents, children, and siblings and their respective spouses.
  3. Participants may only win once during this Giveaway.
  4. Persons who have won a prize in another Giveaway, Giveaway or promotion of any kind from Baxter of California. within the six (6) month period immediately preceding the start date of this Giveaway are not eligible to participate.  Only one person per family or household (whether related or not) may win in any promotion from Baxter of California. during any six (6) month period.

PRIZES:

Each winner (3) will be awarded the following Prize elements:

  • (1) Clay Pomade
  • (1) Deodorant
  • (1) Exfoliating Body Bar

The approximate retail value of the prize per winner is $67. 

  1. Dates and times of receiving prizes promoted by Giveaway sponsors are subject to change and those changes are deemed to be beyond the control of Baxter of California.
  2. Prizes will be awarded only upon winner verification and final approval by Baxter of California.
  3. Prize winner must be claimed via Email/DM correspondence by no later than (48) hours after being contacted or the Prize will be forfeited.
  4. Prizes will be provided via US mail upon receipt and confirmation of winner(s) mailing address.
  5. No substitution of Prize is offered, no transfer of Prize to a third party is permitted and non-cash Prizes may not be redeemed for cash value.
  6. All Giveaway winners must sign and date official Baxter of California release and waiver forms as requested. Failure to do so will result in the winner forfeiting the Prize.
  7. If for any reason a Giveaway winner decides not to accept the Prize awarded, the winner will be required to sign a release form acknowledging forfeiture of the Prize.
  8. It will be at the discretion of the Giveaway sponsor and / or Giveaway administrator if another entrant is to be selected as the winner if time permits.
  9. In the event that any winner is found to violate these Official Rules or is otherwise determined by Baxter of California, he/she may be required to forfeit the prize. If such violation is found after the prize has been used by the winner, he/she will be required to reimburse Baxter of California and/or any sponsor for the stated value of the prize if such a violation is found after the prize has been used by winner.

 GENERAL CONDITIONS:

  1. Winners are responsible for all applicable taxes associated with the receipt of the Prize.
  2. Giveaway Persons in the states of Rhode Island, New York and Florida are not eligible to participate.
  3. Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.
  4. No purchase necessary. Giveaway are void where prohibited. Giveaway are subject to all applicable federal, state and local laws and regulations.
  5. Odds of winning depend upon the number of eligible entrants participating during the Giveaway Period.
  6. By participating in the Giveaway, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Giveaway, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation and must sign a publicity release before acceptance of the prize.  By entering this Giveaway, each participant agrees to comply with the Official Rules and the decisions of the Giveaway sponsor which shall be final and binding in all aspects relating to the Giveaway.
  7. All Giveaway winners will be required to sign a liability release before acceptance of any prize. Under the liability release, the winner or winners will agree to hold Baxter of California, Instagram, any other Giveaway parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against all claims or liability, directly or indirectly related to or arising from or in connection with Giveaway participation or the acceptance, possession or use/misuse of awarded Prize or any portion thereof, or participation in Prize-related activities, including but not limited to any related travel.
  8. Baxter of California retains the right to disqualify any entrant if all Giveaway rules are not followed.  Giveaway void if prohibited by law.
  9. So long as no participant is materially adversely affected, Baxter of California. reserves the right to make changes in these Giveaway rules, which will become effective upon being announced online.
  10. Baxter of California. participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any entrant to complete or continue a telephone call, internet registration or text entry due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries, including any injury or damage to any computer arising from or relating to participation in this Giveaway.  Any use of robotic, macro, automatic, programmed or like entry methods will void all such entries and may subject that entrant to disqualification.
  11. By accepting the Prize, the Winner acknowledges that Baxter of California has neither made nor is in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact, or law, relative to the prize or any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
  12. Baxter of California, its subsidiaries, its affiliates, participating sponsors and promotional partners will not assume any responsibility for any changes in the execution of the Giveaway, including; cancellation of the Giveaway as a result of the occurrence of events, not within the control of Baxter of California, its subsidiaries, affiliates, participating sponsors, promotional partners, such as acts of God, strikes, terrorists acts or criminal acts of third parties. In the event, such an act should occur, Baxter of California. may in its sole discretion, offer the winner comparable prize(s) currently being offered by Baxter of California in place of the Prize originally awarded.
  13. If for any reason, the Giveaway is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of the Giveaway is compromised by virus, bugs, worms or unauthorized human intervention, fraud, an insufficient number of qualified Giveaway entries, or any other causes beyond Baxter of California’s, control which, in Baxter of California’s sole opinion, corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Giveaway, Baxter of California. reserves the right to cancel, terminate, modify or suspend the Giveaway at their sole discretion.
  14. These Giveaway rules are governed by the laws of the State of Maryland.
